The heart of it

It comes down to this: The federal government should not allow its official picture of the nation to be drawn inaccurately because of religious disagreements about the morality of homosexuality.

Yes, this is exactly the heart of the matter. You have nailed the issue in this post. From ignoring legal marriages to spinning, editing, and outright lying about science on climate science to stem cell research, to promoting prosyletization through government funded programs, our elected officials, most notably the current administration and its cohorts but not excluding the current members of Congress, are not only violating the establishment clause of the first amendment, but are attempting to legislate reality. It is very Orwellian in nature, and theocratic in its leanings. I, quite frankly, do not care for this artificial reality they are trying to establish.

Well thought out and well written, Elizabeth. There is no justifiable reason why same-sex marriages should not be counted in the states wherein they are legal and recognized.

Yup – same here.

I wonder if this means our criticism actually had an effect?

They might have figured out that, whatever the ambiguous legal status of 2257, laws around exposing minors to porn are being enforced, and there's plenty of people out there who are going to damn well try to hold SPC to the same laws as anybody else who displays porn.

I think if they want to elevate the level of debate beyond legal technicalities and on to matters of substance, they ought to simply play by the rules – make due dilligiance to conform to the very laws they support and create what critical media they can within such strictures.

It sure seems like they weren't expecting someone to look behind that curtain of righteous indignation they employ to disguise their porn show booths.

Maybe they should just stop being hypocrites if that makes them uncomfortable, and toss the curtain into the recycling bin. I'll bet James Dobson would be happy to reuse it.

That is a change. I did download the slideshow a few days ago. Now when I go to the SendSpace page where the file is kept I see that password box too, with this message: This file has been password protected by the uploader*

Do you think this is a result of the pressure or the arguments being applied at BPPA and here?

I had thought so too at first, but actually it isn't taken down. If you click on the Slideshow tab and follow the age-screening link then you can't get the show. Perversely, if you click on the Toolkit link (the only age screening is this statement: "(Clicking this link will re-direct you to a third-party server and by doing so you acknowledge that you are at least 18 years old.") you can get both the script and the powerpoint file.

The slideshow has been temporarily taken offline. We apologize for any inconvenience.

Are we getting through? Are they embarrassed to be caught distributing porn?

"European" Men don't use condoms!

As a Scottish woman living in the US, I was shocked at just how willing American men are to put on a condom. Back home in Scotland and elsewhere in Europe, I've always been the one who's had to suggest a condom (and lest I offend David by the blanket term "Europe", I should clarify that I'm referring to European men of many different countries). I don't know why this should be the case. Maybe Americans are just more paranoid about disease. Who knows?!

But, yes, I would say that we do still need ads like these in "Europe". They're fun and light-hearted, and bring sexual issues out into the open, which is where they always need to be.

Hypocrisy and unclear law

I've just posted at BPPA about this as well.

I think a lot of this debate is confused by the unclear legal status of 2257 at the moment.

Basically, the earlier version of 2257 was fairly lax when it came to distribution, as opposed to production, of porn. Last year's amendments to 2257 greatly expanded the definition of "secondary producer" to include anybody distributing or showing pornographic images. In fact, one of the reason the amendments were so strongly opposed by free speech advocates is because of the effect that it might have on sexual expression, particularly the sex-related blogosphere who were suddenly all "secondary producers" of pornographic images they might make use of under normal fair-use provisions. The Sixth Circuit Court decision last year has left all of 2257 in legal limbo.

As it stands, I don't think they're in violation of 2257 right now, though I think when it comes to laws about potentially exposing such material to minors. On one hand, there are an awful lot of internet sites that violate this, however, John Stagliano is facing jail time for this, which is a clear signal that such laws are in effect. I really don't think there's an "educational" exception for allowing minors to see outright porn, so I think Stop Porn Culture is clearly in violation of the law here. What's particularly galling as that these are the kinds of laws that Stop Porn Culture is very likely to support when enforced against others.

I do think they need to be called out on the hypocrisy of this, in any event. If porn is really so harmful, both to the viewer and those being viewed, then surely what they're doing is further victimization. (I've even seen some anti-porn folks claim that viewing porn makes you a rapist by extension. So what are these people doing?) I don't believe this, of course, and I think their actions help undermine their case.

More importantly, its really rather disgusting the way they use the performers in the images as poster children for their political views on porn, on sex, and on gender. I'd put money on the likelihood that if there was some way of finding an polling the women on whether they agreed with the views of Stop Porn Culture, you'd see very little agreement.

hypocrisy & self-righteousness

nice well rounded discussion. Free speech and regulation of free speech are not supposed to be dependent on the identity, affiliations, popularity or political influence of the speaker, or in this case distributor/publisher. A hallmark of these groups is their flouting of laws, justified by a stated higher purpose, while seeking harsh law enforcement against others based on their subjective moral judgment. We must fight this hypocrisy and bring it to light to educate the general public regarding these tactics.

Stop Porn Culture and 2257

Elizabeth-

First, thanks for writing this!

-When a porn company compiles images and footage from other films for a new film ( a best of, as it were) it counts as new product…I figure the same law should apply. Also, it's been a long time since I was in school, yet, for something to be considered educational in a scientific sense, there is a hypothesis, testing, data collection, proof…in SPC, we merely have a hypothesis, none of those other stages. Even Dines herself states "there are no good studies" (Penn & Teller, Bullshit). In other educational realms, debate is also used as a way to formulate opinions, and they do not allow that in any sense. On the legal front, currently John Staglinao is embroiled in a court case because a trailer for film made by his company "might be" viewed by minors on the Internet. The Slide Show might also be viewed by minors on the Internet (or in person). This seems to be a valid legal matter to me.

As for challenging them on their hypocrisy…I do that every day, as much as possible. More people really need to.

The coathanger

The signifier of the coathanger may also lay dormant, but then along comes something that reinforces it. The UK the film Vera Drake did this. The protagonist in the film did not use coathangers but rather the issue was debated and that debate strengthened the symbol.

As a woman who identifies as bi, I particularly agree with your comment that not all the letters in LGBT are equal. For many years I identified as straight, but with the qualifier of having fooled around in college. I did this mostly out of a desire to not offend anyone since my long term relationships have always been with men.

I get annoyed when people dismiss bisexuals as slutty fence-sitters, as if we're omnisexual beasts, preying on the choicest cuts of meat in the room without regard for the feelings of the straights or gays.

In reality, it is sometimes extremely hard to be bi. I have married a man, but that doesn't stop my craving for women. When I've been with women, I miss the feeling of a man's cock (as opposed to a toy) deep inside me. It is often confusing because you feel like you're always missing out on something. You then beat yourself up for not being able to pick a side, a person, a sex to be with.

Binaries are never good, and trying to straddle the line is often painful, like doing splits on the edge of a knife.

Ironically, as the community has gained acceptence, we have stopped being so accepting. As with feminism, if we spend all our time going after each other, we'll never achieve our goals, and like the ERA, equal protection for gays of all flavors might be lost to our own in-fighting. If we could learn a lesson from the Second Wave of Feminism, I would hope that the lesson might be to stop trying to create a smaller and smaller definition of what it means to be "gay" (or a "feminist") and excluding those who want/need to help you the most.

In feminism, the white upper class women cut dykes, poor women, and women of color out of the movement. Let's try not to do the same thing to Transgendereds, Bi's, Drag Queens, and the (as you put it) more queer among us in the Gay community.

i'm sure that pregnancy

i'm sure that pregnancy rates overall are falling in most european countries, however teen pregnacy is shockingly visible here in england.

and we have to remember that condoms not only prevent pregnancy but STI/STD's also!

Britain has the second highest teenage birth rate in the developed world, according to a new report from the United Nations.

The United States is the only country with a higher proportion of teenage mothers, with 52 per 1000 compared with 32/1000 in the United Kingdom. The lowest birth rates were found in Korea, Japan, Switzerland, the Netherlands, and Sweden, where less than 7 girls per 1000 gave birth.

i myself am shocked that in a country where every form of pregnancy prevention is freely available and accessible, young girls are still getting pregnant at very young ages

The debate on how best to tackle teenage pregnancy has arisen again as latest figures show the rate in under-16s in England and Wales has increased.

The government says it can do no more without the help of parents, while others are again calling for a broadening of sex and relationship education in schools.

Three sisters who gave birth at 12, 14 and 16 recently hit the headlines

and while we are on the subject....i just have to mention how uncomfortable i am with the british term of a woman "falling pregnant"

Every year, almost 50,000 girls under 18 fall pregnant, leading critics to claim that government-led efforts to encourage safer sex are backfiring. The number who conceive is at its highest level since a multi-million-pound teenage pregnancy crackdown almost a decade ago. i happen to like the advert....(sorry elizabeth, i have made a pig's ear of this comment...HELP!)
