 <description>&lt;p&gt;Hi Anthony,&lt;/p&gt;&lt;p&gt;Thanks for your thoughts. &lt;/p&gt;&lt;p&gt;Couple things-&lt;/p&gt;&lt;p&gt;The newspaper article above doesn&amp;#39;t mention the actual name or docket number of the case, and I&amp;#39;m having trouble finding the opinion at the Fifth circuit&amp;#39;s website, so I can&amp;#39;t tell exactly who said what in the ruling.  It was handed down on February 12th, so it should be there, I&amp;#39;m just not recognizing the case by its official name. &lt;/p&gt;&lt;p&gt;Also, although this is great news that the Fifth pulled it&amp;#39;s head out of its collective butt, and pulled Texas lawmakers out of Texas panty drawers, remember that the Eleventh went the other way.  I&amp;#39;m not optimistic of the results should the decision reach the Supremes in that court&amp;#39;s current state.  Hopefully it won&amp;#39;t make it there until sanity is restored to the majority on that bench.&lt;/p&gt;&lt;p&gt;As you point out, however, the Fifth is a very conservatively appointed court, so maybe I&amp;#39;m wrong about the SCotUS as well.&lt;/p&gt;&lt;p&gt;Of the sixteen judges currently seated on the Fifth circuit, &lt;a href=&quot;http://en.wikipedia.org/wiki/United_States_Court_of_Appeals_for_the_Fifth_Circuit#Current_composition_of_the_court&quot; title=&quot;Current Composition of the Fifth Circuit&quot;&gt;they break down like this&lt;/a&gt; :&lt;/p&gt;&lt;p&gt;1 appointed by President Carter&lt;/p&gt;&lt;p&gt;4 appointed by President Reagan&lt;/p&gt;&lt;p&gt;3 appointed by President Bush the elder&lt;/p&gt;&lt;p&gt;3 appointed by President Clinton&lt;/p&gt;&lt;p&gt;5 appointed by President Bush the younger&lt;/p&gt;&lt;p&gt;1 empty seat with a nomination pending&lt;/p&gt;&lt;p&gt;Let me amend this comment for accuracy to add that there are five Senior Judges listed as not active, and they break down like this:&lt;/p&gt;&lt;p&gt;1 appointed by President Carter (Judge Reavley, see following comment)&lt;/p&gt;&lt;p&gt;3 appointed by President Reagan&lt;/p&gt;&lt;p&gt;1 appointed by President Bush the elder &lt;/p&gt;</description>
